Benn admitted that he was initially arrested on October 24, 2016 for being an unlicensed driver. He also admitted that he was stopped by a traffic officer and asked to produce his documents for the motorcycle he was riding but did not comply. He was arrested and taken to the Anna Regina Police Station from where he escaped.
In plea of mitigation, Benn told the court that he was unaware of the consequences and begged for a non-custodial sentence. Also in mitigation, his lawyer Latchmi Dindyal told the court that his client was unaware that once he was under arrest for a traffic offence he could not leave the Police Station and as such apologised on his client’s behalf.
In response magistrate Scarce told Benn it’s against the law to leave custody while under arrest. He also told Benn the offence has up to 5 years imprisonment and cautioned him.
He was fined $50,000 with an alternative of six weeks imprisonment.
